Terms & Conditions

These Terms & Conditions govern your use of the Emerge Weight Loss website and services. By accessing or using our site, you agree to be bound by these terms.

1. Medical Disclaimer

Emerge Weight Loss provides telehealth services that include weight loss assessment, prescription, and symptom management. Our services do not replace regular medical care, and you should consult with your primary healthcare provider before starting any new weight loss program.

2. Eligibility

To use our services, you must:

  • Be at least 18 years old.

  • Provide accurate and complete information during the intake process.

  • Not have any contraindicated medical conditions, such as Multiple Endocrine Neoplasia Syndrome Type 2 or medullary thyroid cancer.

3. Off-Label Use of Prescription Medications

3.1 Definition

"Off-label use" means prescribing an FDA-approved medication for a use, dose, regimen, route, or patient population not specifically listed in its FDA approval. Off-label prescribing is legal and is a recognized part of medical practice. The FDA regulates drug approval and labeling; the practice of medicine, including off-label prescribing, is regulated by state medical boards.

3.2 Scope

Medications prescribed through Emerge Weight Loss, including GLP-1 and dual GIP/GLP-1 receptor agonists such as semaglutide and tirzepatide, may be prescribed off-label — for example, at doses, titration schedules, BMI thresholds, or combinations not specifically reflected in the FDA-approved labeling for the branded product.

3.3 Compounded Medications Are Not FDA-Approved

Some medications dispensed through Emerge are compounded preparations prepared by our partnered state-licensed 503A compounding pharmacies. Compounded medications are not FDA-approved. The FDA does not review compounded preparations for safety, effectiveness, or quality. Each compounded preparation is prepared based on a prescription written by a licensed provider for an individual patient.

3.4 Clinical Judgment

All prescriptions are issued by a licensed provider acting within the scope of their license and in accordance with applicable law, based on the patient's intake, medical history, and the prevailing standard of care.

3.5 No Guarantee

Emerge makes no representation, warranty, or guarantee regarding safety, efficacy, weight loss, or other clinical outcomes. Individual results vary.

3.6 Risks

All medications, including off-label prescriptions and compounded preparations, carry risks and possible side effects, some of which may be serious. Patients must review the medication-specific risk information provided with each shipment and promptly report new or concerning symptoms. Ongoing patient support is available by text at (305) 930-7387 and email at patients@emergeweight.com. Emerge does not provide phone-based clinical care. In any emergency, call 911 or go to the nearest emergency department.

3.7 Patient Acknowledgment and Consent

By accepting these Terms and accepting shipment of any prescribed medication, the patient confirms that they:

 

Understand the off-label use and compounded medication use described above;

Have had the opportunity to ask, and have asked, any questions they wished to ask of a licensed provider by text or email before accepting shipment;

Have provided complete and accurate medical information during intake; and

Consent voluntarily to off-label and/or compounded medication use as part of their Emerge treatment plan.

 

Consent is voluntary and may be withdrawn at any time by contacting our support teams at patients@emergeweight.com or by text to (305) 930-7387; withdrawal may affect continued treatment.

4. Prescription Fulfillment

All prescriptions are fulfilled by our partnered FDA-regulated 503a & 503b compounding pharmacies. Medications will be shipped directly to your address, and you are responsible for receiving and storing them as instructed.

5. Payment & Refund Policy

  • Payments must be made in full at the time of order.

  • For information on refunds and cancellations, please refer to our Cancellation and Refund Policy.

  • If you experience any issues with your medication or service, please contact us for support.

6. Limitation of Liability

Emerge Weight Loss is not liable for:

  • Any adverse reactions or side effects from medications.

  • Misuse of medications or failure to follow medical instructions.

  • Delays or errors in shipping caused by third-party carriers.

In the event of severe side effects, such as pancreatitis, seek immediate medical attention.

7. Intellectual Property

All content on our website, including text, graphics, and logos, is the property of Emerge Weight Loss and may not be used without prior written consent.

8. Changes to Terms & Conditions

We reserve the right to update or modify these terms at any time. Continued use of our services constitutes acceptance of the revised terms.
